On behalf of the defendants, Clary offered expert testimony based on his research of the original survey of the area, which was conducted in 1833 by the City’s Bureau of Land Management, and again in 1849. Clary’s job was to walk in the shoes of the original surveyor, rather than create a new survey. Through his diligent research of documents archived with the State of Florida, as well as those on file with the only survey firm with records that survived Jacksonville’s Great Fire of 1901, Clary was able to clearly determine the original boundary of the disputed property. As a result, the defendants prevailed.
