Jacksonville, FL — December 23, 2004 — For those in the market to develop a new piece of property, researching property boundaries often can seem like a daunting task. These days, it is not uncommon for the issue of land boundaries to become a matter for the courts to decide. As the industry leader for professional surveying and mapping services throughout Florida, Jacksonville-based Clary & Associates, Inc. is providing land developers with some much-needed peace of mind.
Offering a multitude of professional surveying and mapping services, such as expert land boundary determinations, accurate property descriptions, right-of-way mapping and identification of potential legal problems, Clary & Associates quickly is becoming a first line of defense for property owner rights. Savvy land buyers are securing professionally licensed land surveyors for everything from proposed plot plans to court risk mitigation.
“Last August, we were enlisted to provide expert testimony during a Duval County Circuit Court case regarding a boundary dispute between the owners of adjoining parcels of investment real estate,” said Greg Clary, founder and president of Clary & Associates, Inc. “In researching such boundaries, it is never enough to depend on deeds or a proportionate section breakdown of the land. Research should include such items as original government field notes, historical records, surveys, and evidence that includes section corners.”
On behalf of the defendants, Clary offered expert testimony based on his research of the original survey of the area, which was conducted in 1833 by the City’s Bureau of Land Management, and again in 1849. Clary’s job was to walk in the shoes of the original surveyor, rather than create a new survey. Through his diligent research of documents archived with the State of Florida, as well as those on file with the only survey firm with records that survived Jacksonville’s Great Fire of 1901, Clary was able to clearly determine the original boundary of the disputed property. As a result, the defendants prevailed.
“Greg’s assistance and testimony were invaluable to our case,” said Hank Holbrook, partner in Holbrook, Akel, Cold, Stiefel & Ray, P.A. “It is extremely important to have a surveyor who knows the law with regards to boundary disputes, and who understands the legal principles that the court must use to establish a boundary line. Not only did Greg go back and trace the original surveyor’s steps, he also provided us with legal research that we used in our final arguments and in getting the court’s decision upheld on appeal. Any time you try a case such as this in front of a judge, there’s no substitute for having the historical record to support your case. Greg is highly knowledgeable and very impressive as an expert in his field. In the future, any time I have a surveying case before the court, I’m taking Greg Clary with me.”
